Terms of Use

Welcome to the website of the Orthoplastic Limb Preservation Society (“OLPS,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our websites, online forms, membership areas, referral requests, and donation features (collectively, the “Site”). By accessing or using the Site - including submitting information, applying for membership, making a donation, or participating in OLPS memberships - you agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use immediately.

1. Purpose and Mission

The Orthoplastic Limb Preservation Society is a professional organization dedicated to advancing clinical, research, and educational efforts in limb preservation and orthoplastic surgery. The Site is designed to facilitate professional collaboration, patient inquiries, and charitable support for the Society’s mission. All content and activities on this Site are for informational and educational purposes only and do not constitute medical advice.

2. Acceptance of Terms

By using the Site, you agree to comply with these Terms, our Privacy Policy, and any additional guidelines posted. OLPS reserves the right to amend these Terms at any time. Updates will take effect upon posting.

3. Eligibility

You must be at least 18 years of age to use the Site, submit any forms, or make a donation. By using the Site, you represent that all information you provide is truthful, current, and complete.

4. Membership, Applications, and Fees
  1. Access to member-only areas (case discussions, forums, and resources) requires acceptance into OLPS membership.

  2. All applications require submission of a non-refundable application fee, whether or not acceptance is granted.

  3. OLPS reserves the right to accept or deny membership at its sole discretion.

  4. Membership does not establish an employment, agency, or partnership relationship with OLPS.

5. Payment Terms
  • All fees (application or membership) must be paid through the secure payment system provided on the Site.

  • Application fees are non-refundable, regardless of the outcome.

  • Membership fees are billed as described during checkout.

  • OLPS is not responsible for processing errors, technical malfunctions, or unauthorized transactions made through third-party payment providers.

6. Donations and Charitable Contributions
  1. The Site may include a feature allowing users to make voluntary donations in support of OLPS’s educational, clinical, and research initiatives.

  2. Donations are non-refundable and do not confer membership, influence, or decision-making rights within OLPS.

  3. All donations are used solely for mission-related purposes, including - but not limited to - research, education, clinical collaboration, outreach programs, and resource development.

  4. Donors acknowledge that OLPS is not currently a registered nonprofit entity (unless and until official 501(c)(3) status is confirmed) and therefore donations may not be tax deductible.

  5. OLPS will provide a donation receipt via email but makes no representation regarding tax eligibility.

  6. Donors agree not to impose conditions or restrictions on the use of donated funds unless expressly agreed to in writing by OLPS.

  7. OLPS reserves the right to redirect contributions toward general support if a designated fund is unavailable or discontinued.

7. Intellectual Property Rights

All content on the Site - including text, images, graphics, videos, documents, and logos—is owned by OLPS or its licensors and is protected by copyright and trademark laws. You may access and download materials for personal, educational, and non-commercial purposes only. You may not reproduce, distribute, or modify any OLPS content without prior written permission; use OLPS trademarks, logos, or imagery for endorsement or advertising; mirror or scrape any portion of the Site.

8. User-Generated Content

Users who contribute posts, case discussions, or materials (“User Content”) retain ownership of their submissions but grant OLPS a perpetual, royalty-free, worldwide license to use, reproduce, and distribute such content for educational and research purposes. You warrant that you have full rights to post the content; you have obtained necessary patient consents, if applicable; the content complies with all laws and professional ethics standards. OLPS reserves the right to remove or restrict User Content at its discretion.

9. Professional Conduct

Users agree to maintain professionalism in all interactions. Prohibited conduct includes posting defamatory, harassing, or discriminatory statements; sharing confidential patient or institutional information; misrepresenting identity or credentials; using the Site for commercial solicitation or spam. Violations may result in suspension or termination of membership or Site access.

10. HIPAA Compliance and Patient Consent

All members are required to comply with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and applicable state privacy laws. Any identifiable patient data shared within OLPS forums must be de-identified. Written patient consent must be obtained before posting identifiable cases, using the OLPS Patient Consent Form provided. OLPS assumes no responsibility for user violations of HIPAA or other privacy laws. You are solely responsible for maintaining copies of all signed consent forms.

11. Confidentiality

Member discussions and case exchanges are private and must remain confidential. Unauthorized sharing, screenshots, or redistribution of OLPS member content is strictly prohibited.

12. Patient Submissions and Referral Requests

The Site allows patients or representatives to voluntarily submit information (such as their condition, location, or medical history) to request a referral to a qualified provider. By submitting this form, you acknowledge and agree that the submission is voluntary and may include personal or health information; it is not intended for emergencies - patients experiencing urgent symptoms should call 911 or visit an emergency facility; submitting this form does not create a doctor-patient relationship with OLPS or any affiliated provider; OLPS may share submitted information with participating medical professionals solely for referral purposes; OLPS does not guarantee a referral, endorse specific providers, or assume responsibility for provider availability, outcomes, or actions; OLPS may use anonymized submission data for educational or research reporting; you consent to the limited use and transmission of your data for referral facilitation under these Terms and our Privacy Policy.

13. Patient Information

The Site may include case discussions, clinical materials, or public forms that involve Patient Information. You agree to comply with all laws and regulations regarding retrieval, transmission, or disclosure of Patient Information; obtain and maintain required consents and authorizations; use such information solely for legitimate educational or referral purposes; accept sole responsibility for your use, misuse, or storage of Patient Information. OLPS disclaims any liability for user violations of patient confidentiality or privacy laws.

14. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which describes how OLPS collects, uses, and safeguards personal and health information. By using the Site, you consent to OLPS’s data practices.

15. Third-Party Links

The Site may link to third-party websites or tools. OLPS does not control or endorse third-party content or services and is not responsible for their accuracy, availability, or privacy policies.

16. Educational and Clinical Disclaimer

All content provided through OLPS is for educational and informational purposes only. OLPS does not provide medical advice, diagnosis, or treatment, and nothing on the Site should be interpreted as a substitute for professional medical judgment.

17. Disclaimers of Warranties

The Site and its content are provided “as is” and “as available.” OLPS disclaims all warranties, express or implied, including those of accuracy, reliability, or suitability for a particular purpose.

18. Limitation of Liability

To the fullest extent permitted by law, OLPS, its officers, directors, affiliates, and members shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site or any donation, membership, or referral activity. In no event shall OLPS’s total liability exceed the greater of (a) the total amount paid by you in the preceding twelve months, or (b) one hundred dollars ($100).

19. Indemnification

You agree to defend, indemnify, and hold harmless OLPS, its officers, employees, members, and affiliates from any claims, damages, losses, or expenses arising from your use of the Site, your submissions, or your violation of these Terms.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law rules. All disputes shall be resolved first by negotiation, then mediation, and, if necessary, binding arbitration in Baltimore County, Maryland, under the rules of the American Arbitration Association. You waive any right to a jury trial or participation in a class action.

21. Changes to the Site

OLPS reserves the right to modify, suspend, or discontinue any portion of the Site, including member areas, forms, or donation features, without notice.

22. Severability and Entire Agreement

If any provision is held invalid, the remainder shall remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and OLPS.
